Abstract
O presente artigo objetiva estudar a alienação parental a partir das mudanças pelas quais passa a família brasileira na atualidade. Para tanto, foram abordados o conceito de família, bem como os princípios protetores das crianças e adolescentes, com destaque para o fenômeno da síndrome da alienação parental, uma enfermidade que acomete os filhos em casos de disputa judicial entre os seus genitores. Ademais, também foi analisada a prática da alienação parental como um fenômeno social e jurídico, seu conceito, suas características e suas consequências no direito brasileiro. A metodologia utilizada no estudo foi a compilação bibliográfica através da revisão da literatura, tendo como base os autores que abordam a temática trabalhada. Partindo desta doutrina e dos dispositivos jurídicos examinados, como a própria Constituição Federal (1988), o Estatuto da Criança e do Adolescente (1990) e a Lei da Alienação Parental (Lei nº 12.318/2010), têm-se as ferramentas necessárias à regulamentação e identificação das práticas alienantes, conseguindo evitá-las ou puni-las para que o menor sofra o mínimo possível. Por fim, chegou-se à conclusão de que o genitor alienante poderá ser responsabilizado civilmente pelos danos causados a criança ou adolescente e ao outro genitor, por ferir a sua dignidade humana dos atingidos, por todo o desgaste emocional gerado e pelo tempo perdido na convivência entre genitor e filho, que não se recupera.
