Abstract
De manera tradicional, se considera que el derecho de contratos está uniformemente fundamentado en el individualismo. Este sustento normativo afirma la diferencia entre los intereses propios y ajenos, abogando por el predominio del autointerés. Sin embargo, los recientes eventos que han incidido en la contratación invitan a evaluar críticamente si solo hay un fundamento normativo común. Al respecto, la solidaridad y el altruismo desafían los postulados del individualismo y pueden esgrimirse como candidatos para la fundamentación del derecho contractual. Este trabajo explora tal posibilidad y busca posicionar la solidaridad y el altruismo en ese ámbito. Finalmente, se muestra en qué sentido el altruismo tiene mayor pertinencia que la solidaridad para fundamentar el derecho de contratos y hacer frente al prisma individualista.
