Abstract
Kepadatan penduduk khususnya di perkotaan tidak hanya karena bertambahnya penduduk namun juga disebabkan adanya warga negara asing (WNA) yang memiliki pekerjaan atau berusaha berada di Indonesia. Hal tersebut pula yang menyebabkan semakin meningkatnya permintaan akan kebutuhan rumah tempat tinggal baik yang horizontal maupun vertikal berupa rumah susun. Tempat tinggal serupa itu tidak hanya dibutuhkan bagi warga negara Indonesia, tapi juga bagi WNA yang tinggal di Indonesia karena alasan kepraktisannya namun dengan fasilitas yang lengkap. Kepemilikan rumah susun untuk WNA diperkuat dengan diundangkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UU Cipta Kerja). UU Cipta Kerja dicabut dan dinyatakan tidak berlaku dengan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja. Dalam Perpu tersebut pada Pasal 144 menyatakan bahwa satuan rumah susun dapat diberikan kepada WNA yang memiliki izin. Adanya ketentuan ini dari awal telah menimbulkan pro dan kontra di masyarakat, karena dinilai menguntungkan WNA. Oleh karena itu kajian ini dibuat bertujuan untuk menganalisis konsep kepemilikan satuan rumah susun oleh WNA serta perlindungan hukum yang diberikan oleh pemerintah terhadap WNI atas kepemilikan satuan rumah susun oleh WNA. Guna memecahkan permasalahan hukum dalam kajian ini menggunakan pendekatan undang-undang (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian ini menemukan bahwa WNA hanya dapat memiliki rumah susun yang dibangun diatas tanah Hak Pakai, serta dengan jenis rumah susun komersial saja.
