Abstract
Au Québec, l’interdiction de toute discrimination fondée sur le handicap, ainsi que l’interdiction de toute atteinte à la vie privée, figurent notamment dans la Charte des droits et libertés de la personne. Appliquées au stade de l’embauche, ces interdictions empêchent un employeur de solliciter des informations sur l’état de santé d’un candidat à un poste. Néanmoins, une exception existe : lorsque les aptitudes ou qualités requises par l’emploi l’exigent. L’usage des questionnaires médicaux de préembauche, par les employeurs publics comme privés, tente de s’insérer dans cette exception et interroge le périmètre de protection offert par les normes juridiques applicables.
