Abstract
Este artigo aborda o panorama legal e regulatório do setor de transporte rodoviário interestadual de passageiros no Brasil no ano de 2022, oito anos depois de o legislador abolir as regras que exigiam a licitação para a prestação dos serviços e estabelecer a autorização como novo modelo de outorga, apresentando as controvérsias suscitadas aos tribunais e o seu impacto para a implementação do novo marco regulatório. Para esse fim, o trabalho apresenta, de um lado, o resultado de uma pesquisa que buscou identificar as ações judiciais propostas com o objetivo de questionar a outorga de autorizações nos moldes da Lei no 12.996/2014 e o posicionamento dos tribunais e, de outro lado, uma crítica aos desafios impostos pelos atores institucionais, em especial Judiciário, Congresso e Tribunal de Contas da União, em razão da imposição de barreiras à entrada mediante limitações jurídicas e regulatórias ao ingresso de novos prestadores de serviço e à implantação da livre concorrência no setor.
