Depuis le début du xxie siècle, les questions d’éthique concernant la conservation des restes humains archéologiques dans diverses institutions sont devenues des préoccupations centrales tant pour les communautés que pour les chercheurs. En contexte universitaire, celles-ci prennent particulièrement leur sens dans le cadre de la gestion de collections héritées de recherches réalisées au siècle dernier. La redécouverte des restes squelettiques d’un enfant d’origine mésoaméricaine (el niño) dans les collections ostéologiques du Département d’anthropologie de l’Université de Montréal a suscité des réflexions éthiques qui ont mené à la décision de les rapatrier en leur terre d’origine. Cette démarche de rapatriement à l’international, une première pour cette institution, est décrite dans cet article. Celle-ci donne également l’occasion de se pencher sur le chemin parcouru, et sur celui qui reste à faire, dans l’encadrement éthique et législatif des collections bioarchéologiques héritées du xxe siècle au Québec et ailleurs.
