Christine Baron remarque dans La Littérature à la barre (2021) que le début du xxie siècle est caractérisé par une très grande présence du droit dans les arts et la littérature. Plusieurs auteur·rices tendent à insérer des extraits de documents juridiques à même leur texte pour se coller au réel. Or cet intérêt pour la justice — à la fois éthique et institutionnelle — n’est pas sans effets sur les sujets des procédures judiciaires, comme des œuvres littéraires. Que les motivations des auteur·rices soient morales ou non, ces remaniements sont retenus à charge lors de procès littéraires pour atteinte à la vie privée. En croisant les décisions de justice, les textes des œuvres et les entrevues accordées par les différentes parties de deux cas de réécriture d’un fait réel qui a été judiciarisé, soit L’Enfant d’octobre (Besson, 2006) et Les Petits (Angot, 2011), il sera question de cibler les éléments de tension entre la justice dans la littérature et la littérature dans la justice.
