Das Curriculum Ethik und religiöse Kultur (Ethique et culture religieuse - ECR), das 2008 in Québec eingeführt wurde, bildet die letzte Etappe eines langen Prozesses der Dekonfessionalisierung der Schulen in Québec. Dieses nicht konfessionelle Curriculum, das sich als Antwort auf die Herausforderungen des Pluralismus der québec’schen Gesellschaft versteht, hat einen gewissen Widerstand, darunter zwei juristische Anfechtungen, ausgelöst. In beiden Fällen war das Obligatorium Teil der Auseinandersetzung. Der Beitrag analysiert diese beiden juristischen Fälle, indem er die darin entfalteten zentralen Argumente in Bezug auf die Ziele und die Struktur des ECR-Curriculums situiert. Die Wichtigkeit, das Obligatorium des Unterrichts beizubehalten – um adäquat auf die Herausforderungen des Pluralismus antworten zu können – und die Frage der Verletzung der Religionsfreiheit, welcher von den Richtern in den verschiedenen Instanzen besondere Aufmerksamkeit zukam, stehen im Zentrum der Analyse.
