Abstract
Face au très faible niveau de mise en oeuvre des droits économiques et sociaux dans la plupart des pays en développement, on ne peut que s’interroger sur les facteurs explicatifs. En effet, si l’effectivité de ces droits est fonction des ressources disponibles, il convient, d’une part, d’évaluer les capacités de l’État à mobiliser ces ressources et, d’autre part, de suivre la manière dont l’État organise l’accès aux biens et services de base par les différentes couches de la population. À un niveau comme à un autre, on pourrait relever de sérieux défis dont les principaux seraient fortement liés à des pratiques de corruption. Celle-ci intervient en amont dans la mobilisation des ressources et, en aval, dans la fourniture des services publics essentiels. Abordant la question de la corruption sous le prisme des droits de la personne — économiques et sociaux, cet article cherche à démontrer l’existence d’un droit de la personne à l’interdiction de la corruption à partir de la double interdiction des pratiques y afférentes en droit international.
