Abstract
En l’absence de concepts adéquats dans la Convention de Vienne sur le droit des traités, les auteurs suggèrent d’interpréter ledit instrument de sorte à y intégrer la notion de hardship, fondée à la fois sur le principe de la bonne foi et sur celui du rebus sic stantibus, conduisant ainsi à reconnaître l’existence d’une obligation de renégociation. Une telle interprétation s’avère plus que nécessaire en raison de la crise économique causée par le SRAS-CoV-2 (COVID-19), durant laquelle plus d’un État ne sera plus en mesure d’honorer ses obligations conventionnelles internationales.
