Abstract
La justice restaurative (JR) en France a connu une mise en oeuvre « officielle » à la Protection judiciaire de la jeunesse (PJJ) dès 2018 à la suite de l’appel à projets lancé par la Direction de la PJJ (DPJJ). Depuis le 30 septembre 2021, l’avènement du Code de justice pénale des mineurs (CJPM) a légiféré en droit pénal des mineurs ces pratiques dans le titre préliminaire du code relatif aux principes généraux de la justice pénale des mineurs. Si la JR relève d’une approche basée sur les droits de l’enfant, constitue-t-elle pour autant un droit accessible pour lui ? Le recueil et l’analyse des témoignages de près de cinquante professionnels de la PJJ (cadres territoriaux et professionnels des services) montrent que si la JR est avancée comme un droit, un ensemble de facteurs limite l’accès des jeunes à ce dispositif (moyens, logique de contrôle, culture éducative et protectionnelle).
