Abstract
Le concept des communs prend une place de plus en plus importante dans la sphère juridique depuis une trentaine d’années. Les expériences italiennes concernant les beni comuni sont sans doute parmi les initiatives les plus abouties de théorisation du concept. La gestion des beni comuni en Italie revêt des formes diverses, modelées par l’action des citoyen.ne.s et mobilisant le droit civil selon les besoins spécifiques en l’espèce. Il s’agit là du point de départ d’une réflexion plus large sur la forme que peuvent prendre les communs, ainsi que sur leur place dans le cadre juridique québécois.
