Abstract
La fraternité s’entend généralement comme la loi de l’amour. Dépassant désormais le cadre familial qui l’a vu naître, elle est souvent perçue telle l’une des inventions de l’hypocrisie sociale. Pourtant, sa dimension altruiste lui donne toute sa fertilité. L’ambition de la réflexion de l’auteure est de démontrer que la fraternité, sans laquelle tous les avantages publics et individuels seraient douteux et précaires, est un objectif structurant de l’ordre juridique en droit civil. Indispensable pour le respect de la dignité de la personne, elle permet une humanisation des relations sociales. Elle apparaît aujourd’hui en tant que matrice des principes gouvernant les relations entre les individus. Cette reconnaissance contemporaine de sa capacité à légitimer des droits et des obligations juridiquement contraignantes favorise un dépassement de son essence facultative pour l’imposer dans de nombreux rapports sociaux. Ainsi, à côté d’une fraternité généralement consentie par les particuliers, il existe de nos jours une fraternité imposée par la loi.
