Au cours des dernières années, la catégorie des biens communs s’est imposée dans le débat européen, en constituant le pivot autour duquel s’organisent théories et expériences capables de dessiner, par le bas, des schémas alternatifs du rapport entre hommes et biens, par-delà le public et le privé, et ce en les fondant sur l’accès, la participation, la distribution et la démocratie. De ce point de vue, l’une des expériences les plus intéressantes est assurément celle italienne, où les biens communs ont représenté le cœur de batailles politiques réussies, tout en pénétrant dans les mailles de l’ordre juridique et ainsi bâtissant les présupposés pour des mécanismes institutionnels novateurs. La présente étude, d’une perspective principalement juridique, prend en examen l’expérience italienne des biens communs et des biens communs urbains, dans le but de montrer que cette dernière est en mesure d’indiquer les présupposés théoriques en vue d’une « rupture interne » de certaines catégories traditionnelles du droit civil occidental.
