Da “Justiça” ao “Acesso à Justiça”: Representação, processo coletivo e “Véu da Ignorância”

Abstract
Ao longo das últimas décadas tem se tornado comum, no processo civil brasileiro, a oferta de protagonismo à ideia de acesso à justiça. Também, tem sido cada vez mais corriqueira a defesa de que a proteção coletiva de direitos individuais poderia contribuir para a afirmação desse objetivo. Para avaliar esse discurso, o presente artigo procura recordar que ele deve ser antecedido por uma própria definição suficiente do conceito de justiça. Assim, adota-se como parâmetro exemplificativo a visão desenvolvida sobre o tema por John Rawls, demonstrando que a sua construção teórica, pautada na ferramenta do véu da ignorância, ratifica a adequação da tutela coletiva.
