Abstract
La pandémie de la COVID-19 a eu bien des répercussions sur la société canadienne, notamment en ce qui a trait au monde de l’emploi. La démocratisation et la popularisation du télétravail ont remis en question certains canons du droit du travail. Partant du constat que l’approche contractualiste traditionnelle du droit du travail ne peut expliquer les profonds bouleversements auxquels sont confrontés travailleurs et employeurs depuis deux ans, les auteures proposent de réexaminer la relation de travail dans une optique républicaine. Elles articulent leur réflexion autour de trois axes principaux (lieu de travail, temps de travail et nature du travail) pour avancer que le travailleur d’aujourd’hui est à la recherche d’autonomie, de flexibilité et de sens. Cette remise en question de la place qu’occupe le travail dans notre société dans un contexte postpandémique ouvre la voie à un changement de paradigme dans notre conception de la gestion du travail, et ce, afin d’assurer une plus grande liberté au travailleur.
