Abstract
Abstract It considers the principles and history of staying proceedings for abuse of process. Describing the kinds of conduct giving rise to a stay with a discrete ‘interests of justice’ test applied to two categories of abuse of process. Examining the stages in the justice process when a stay may be granted. Describing the jurisdiction to stay for abuse and the European Court of Human Rights (ECtHR). The rationales for staying proceedings based on nebulous tests: ‘public confidence’, ‘sense of justice’, and ‘rule of law’. It has an historical sketch of the growth in applications to stay and permanency of the same. Examining Abuse of Process in the common law jurisdictions of Canada, New Zealand, and Australia.
