Abstract
La note aborde trois enjeux de l’absence de données fiables sur le travail des tribunaux de juridiction criminelle au Canada. D’abord, l’incapacité de documenter les pratiques centrales des tribunaux qui vont bien au-delà du simple choix de la peine (prison ou non). Ensuite, l’incapacité de bien comprendre les problèmes de disparité, de discrimination ou d’accès à la justice et de proposer des solutions pour y faire face. Finalement, l’incapacité de mesurer les effets réels des réformes ou des transformations des tribunaux. C’est à travers différents exemples concrets que les failles de cette absence de données sont illustrées et que leurs conséquences sont discutées.
