Abstract

No presente artigo buscou-se analisar a aplicabilidade do instrumento da constelação familiar no judiciário brasileiro, mais precisamente no Estado de Minas Gerais, região Sudeste do Brasil, através de uma abordagem quali-quantitativa, considerando suas características e espacialização. A pesquisa foi executada em momentos complementares: inicialmente foi realizada uma pesquisa bibliográfica buscando compreender a constelação familiar e sua normatização. Em seguida, realizou-se uma análise dos dados obtidos em pesquisa de campo referente às Comarcas do Estado de Minas Gerais sobre a aplicação deste instrumento em sede de primeira instância. Esses dados foram projetados em um mapa de georreferenciamento visando uma análise espacial do objeto de estudo. Como resultado, observou-se que, em que pese a constelação familiar ter sido normatizada através da Portaria 3.923/21, pelo Tribunal de Justiça de Minas Gerais (TJMG), sua utilização ainda é muito baixa no Estado de Minas Gerais, concentrando-se apenas em 10 comarcas das 296 pesquisadas.
