Abstract
ปัญหาการติดต่อสื่อสารนอกเวลาทำงานเป็นปัญหาหนึ่งที่พบได้จากการทำงานในปัจจุบัน เนื่องจากการติดต่อสื่อสารที่สะดวกและรวดเร็ว จึงมีการติดต่อสื่อสารนอกเวลาทำงานมากขึ้น ลูกจ้างต้องทำงานนอกเวลาทำงานอย่างหลีกเลี่ยงไม่ได้ โดยนายจ้างสามารถติดต่อและสั่งงานลูกจ้างได้ผ่านทางโทรศัพท์ การส่งจดหมายอิเล็กทรอนิกส์ และการส่งข้อความผ่านแอปพลิเคชันต่างๆ ในโทรศัพท์มือถือ โดยเฉพาะช่วงการแพร่ระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 หรือโรคโควิด-19 ที่มีการทำงานที่บ้าน ซึ่งมีความแตกต่างกับการทำงานปกติ ทำให้การปิดการติดต่อสื่อสารเรื่องงานทำได้ยากขึ้น อันกระทบต่อสิทธิความเป็นส่วนตัว สิทธิการพักผ่อน และสิทธิความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน อีกทั้งกฎหมายแรงงานที่สำคัญที่มีอยู่ในปัจจุบัน คือ พระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 มีการรับรองและคุ้มครองลูกจ้างเกี่ยวกับสิทธิการตัดขาดการติดต่อสื่อสารนอกเวลาทำงานแต่ไม่ครอบคลุมถึงลูกจ้างทุกคนอย่างเหมาะสม รวมทั้งกฎหมายแรงงานอื่นๆ ไม่มีการรับรองและคุ้มครองลูกจ้างเกี่ยวกับสิทธิการตัดขาดการติดต่อสื่อสารนอกเวลาทำงาน วิทยานิพนธ์นี้จึงมุ่งพิจารณาว่าการรับรองและคุ้มครองสิทธิการตัดขาดการติดต่อสื่อสารนอกเวลาทำงานมีความเหมาะสมและเพียงพอหรือไม่ รวมถึงหาแนวทาง รูปแบบ หรือวิธีการที่เหมาะสมในการพัฒนากฎหมาย เพื่อให้มีการรับรองและคุ้มครองสิทธิดังกล่าวอย่างเหมาะสม ในรูปแบบการออกกฎกระทรวงกำหนดมาตรฐานตามพระราชบัญญัติความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน พ.ศ. 2554 เพื่อเป็นการสร้างสมดุลระหว่างเวลาทำงานและเวลาส่วนตัวให้กับทั้งลูกจ้างและนายจ้าง โดยไม่เป็นการกระทบสิทธิของทั้งสองฝ่ายมากเกินไป
