Abstract
La prise en considération des politiques environnementales dans les accords de commerce a connu une évolution intéressante du GATT à l’OMC. Il faut cependant souligner notamment la récente tendance à l’intégration des obligations de protection de l’environnement dans les accords commerciaux de nouvelle génération, où les objectifs environnementaux ont été inclus, non pas comme une exception aux obligations de libre-échange, ni comme une simple reconnaissance du « droit de protection » des États, mais comme une obligation commune. La protection des milieux marins s’inscrit dans ce courant d’évolution. Pour souligner ce changement d’approches dans la régulation internationale – d’une approche sectorielle à une approche globale –, l’analyse se fera en deux étapes. La première consiste à étudier les dispositions relatives à l’environnement dans le GATT et les accords de l’OMC qui ont fait écho dans plusieurs accords commerciaux régionaux de la même époque, et notamment l’interprétation de ces dispositions par les organes de règlement de différend du GATT/OMC dans les affaires ayant lien avec la protection des milieux marins, afin de faire ressortir la priorité des considérations commerciales sur celles de protection environnementale, malgré une certaine démarche évolutive d’interprétation de l’Organe d’appel de l’OMC. Dans la seconde étape, l’étude des dispositions portant sur la protection des milieux marins dans certains récents ACR – PTPGP, ACÉUM, AECG, EVFTA – montre une approche progressiste en faveur de l’environnement, nuancée par un bref regard critique sur l’Accord de Partenariat économique régional global (PERG).
