Abstract
L’assurance islamique (ou takaful) est fille de la religion et de l’éthique musulmanes ainsi que du droit islamique, et les modèles juridiques auxquels recourent ses praticiens en vue de permettre le financement des risques auxquels sont exposés les membres de la communauté sont directement inspirés de contrats correspondant aux impératifs de la Loi (charia) tout en obéissant aux principes éthiques prônés par le Prophète. Bien qu’elles présentent de grandes analogies avec les sociétés d’assurance conventionnelles, les entreprises takaful s’en différencient sur quelques points essentiels et relèvent parfois d’une législation spécifique. En dépit des controverses théologiques sur le concept d’assurance, les spécialistes sont récemment sont parvenus à un consensus à ce sujet.
