Abstract
Les auteurs s’intéressent depuis des années à l’assurance juridique respectivement au Québec pour M. le bâtonnier Pierre Gagnon et en France pour M. Guillaume BRUNEL. M. le bâtonnier Gagnon a présidé le Comité sur l’assurance de frais juridiques du Barreau du Québec pendant une dizaine d’années. À la demande du ministre de la Justice du Québec, il a coprésidé un Comité d’experts qui avaient pour mandat de faire des recommandations visant à favoriser le développement de l’assurance de frais juridiques au Québec. Ses travaux l’ont amené à être en contact avec M. Guillaume BRUNEL, un doctorant à l’Université de Perpignan, dont la thèse concerne l’assurance de protection juridique en France. M. BRUNEL est l’auteur de plusieurs articles déjà publiés sur le sujet. Il a été auditionné par les deux chambres (Assemblée nationale et Sénat) concernant ses travaux en matière d’aide juridictionnelle et d’assurance de protection juridique. Les deux auteurs ont eu le projet de rédiger un article conjoint démontrant les caractéristiques et le développement de ce type d’assurance au Québec et en France. Les auteurs publieront également une version remaniée du même texte pour la revue juridique française La Gazette du palais.
