Abstract
ABSTRAK Impor garam setiap tahun lebih dari 2000 ton baik untuk bahan baku penolong industry ataupun garam konsumsi, semuanya didatangkan dari negara lain tidak memproduksinya sendiri. Negara tidak berdaya melindungi walaupun sederet rancangan perundangan di produksi semuanya hanya pencitraan yang menipu semua mata. Tidak ada mekanisme pengendalian meskipun negara telah menerbitkan PP No.9 Tahun 2018 tentang Tata Cara Pengendalian Impor Garam Bahan Baku Penolong Industri, tidak ada perlindungan meskipun telah terbit UU No.7 Tahun 2016 tentang Perlindungan dan Pemberdayaan Nelayan, Pembudidaya Ikan dan Petambak Garam, seberapa rapuh kontruksi Hukum Administrasi sehingga negara leluasa menipu dengan nama perundangan yang membius pengharapan tetapi sejatinya membunuh dan menikam rakyatnya sendiri dari belakang. Penelitian ini merupakan penelitian hukum yuridis empiris, yaitu metode penelitian terapan interdisipliner, melihat hukum sebagai fenomena sosial. Studi yuridis-empiris mencakup berbagai konteks disiplin ilmu, baik dalam ilmu-ilmu sosial maupun hukum, mengkaitkan hukum dengan dimensi sosiologis, politik dan ekonomi dari aktivitasPenelitian ini menemukan bahwa Indonesia sebagai negara telah kehilangan kedaulatannya dalam memberikan proteksi kepada komoditi garam lokal. Hal ini terjadi karena Indonesia telah menjadi member of GATT sejak tahun 1994 yang dalam salah satu klausul kesepakatan GATT adalah negara tidak boleh menjadi penghalang free market dengan menerapkan kebijakan kuota impor. Penelitian ini menyimpulkan bahwa harus dicari trobosan mekanisme lain yang dapat memproteksi komoditi garam lokal tanpa menabrak ketentuan dalam klausul GATT agar Indonesia tetap dapat menjalin hubungan baik dalam perdagangan internasinal tetapi tetap juga dapat melindungi komoditi garam lokal secara maksimal.
