Abstract
Le présent article étudie la récente évolution du droit vietnamien dans la valorisation du rôle de la jurisprudence, mise dans le contexte historique du droit vietnamien et, lorsque cela est pertinent, par référence au droit québécois. Un survol de l’histoire juridique vietnamien fera ressortir le rôle non négligeable de la jurisprudence dans le droit vietnamien à différentes périodes, ce qui encourage à redonner à cette dernière sa place dans le système juridique actuel. L’étude critique des dispositions législatives et réglementaires, ainsi que de la pratique, révèle cependant certains problèmes conceptuels et radicaux quant au sens de la jurisprudence et à la fonction d’interprétation de la loi par les tribunaux. Cela n’empêche pas que le changement contribue de façon positive à l’évolution du droit vietnamien.
