Abstract
캐나다는 커먼로(common law) 전통(퀘벡 제외)을 가진 나라로서, 법 발전의 역사, 법의 체계 및 기본개념, 사법제도 등 여러 면에서 우리와 다르지만, 위헌법률에 어떻게 대처해야 하는지에 관한 문제의식, 해결의 방향에 있어서는 우리와 유사한 점도 많다.<br/> 법률에 대한 위헌결정의 유형과 효력에 관한 캐나다의 법은 캐나다 헌법 제52조 제1항, 제24조 제1항을 토대로 한 연방대법원의 판례를 통하여 형성, 발전하여 왔다. 연방대법원은 위 헌법조항들에서 출발하여 입헌주의, 법치주의, 권력분립이라는 상호 보완하기도, 상충하기도 하는 세 헌법원리를 축으로 풍부한 헌법적 논의를 전개하면서, 위헌결정의 유형과 효력을 둘러싼 복잡다기한 쟁점들(변형결정, 소급효, 헌법불합치결정, 개별적 구제 등)에 관하여 특유의 해결책을 고안, 발전시켜 왔다. 그리고 이런 문제들에 대한 일반론의 전개와 사안에의 적용과정을 판결문을 통하여 충분히 설명하고 있다.<br/> 연방대법원은 제52조 제1항에 명시된 무효선언 외에도 몇 가지 변형결정(variations)을 개발, 사용하고 있는데, 우리의 헌법불합치결정에 해당하는 것으로 ‘무효선언의 정지’(suspension of declaration of invalidity)가 있다. 캐나다의 헌법불합치결정은 우리나라나 독일과 마찬가지로, 단순위헌결정이 야기하는 법의 공백 등 헌법적으로 바람직하지 않은 상황에 대처하려는 데서 비롯되었다. 캐나다의 헌법불합치결정은 계속적용 헌법불합치결정만을 예정하고 있다. 이때 위헌인 법은 잠정적으로 유효하게 적용되고, 입법자는 정지 기한 내에 개선입법을 마련하게 된다.<br/> 정지 기한이 만료되면 무효선언이 효력을 발생하는데, 이때 소급효를 가지는지 장래효를 가지는지는 법원이 결정한다. 원칙적으로는 소급효가 추정되지만, ‘무효선언 정지’의 목적 달성을 위해 필요한 때에는 장래효만을 인정할 수 있다. 이렇게 되면 (위헌선언된) 법이라도 정지 기간 동안 유효하다가, 정지 기한의 만료 시부터 장래를 향하여만 무효로 된다. 헌법불합치결정과 장래효의 결합은 형벌조항의 경우에도 마찬가지로 가능하다. 이를 통해 (위헌선언된 법의) 합헌적 부분에 대한 계속적용(즉, 합헌적인 형벌권의 행사)의 가능성을 확보하고 있다.<br/> 연방대법원은 정지 기간 동안 위헌법률이 계속 적용됨으로 인한 관련 당사자의 기본권 침해를 막기 위하여, 제24조 제1항을 근거로 ‘정지의 면제’라는 개별적 구제조치를 부여하고 있다. 이는, 헌법불합치결정을 통하여 법의 적정한 운용을 꾀하면서도 여기에 개별적 구제를 결합시켜, 법 적용의 일반성과 권리구제의 개별성 사이에 존재하는 긴장을 조화시켜 나가고 있는 것이라 할 것이어서 높이 평가할 만하다.
