Abstract
O texto objetiva discorrer sobre as relações de convivência familiar enquanto direito ao pertencimento à família no contexto da maternidade em ambientes carcerários. Nesse sentido, os direitos inerentes às crianças e adolescentes submetidos a este cenário fazem parte do seleto grupo dos direitos e garantias fundamentais do ser humano. São analisadas as regras previstas na legislação brasileira para demonstrar a ocorrência ou não do efetivo cumprimento dos direitos básicos da criança e da mãe. O pertencimento a uma família decorre de uma relação de convivência harmônica e qualificada entre eles, quando esta for desrespeitada, violado será o princípio da intranscendência da pena, que veda transferência da punição para outra pessoa. O Supremo Tribunal Federal, no julgamento do Habeas Corpus nº 143.641/SP, decidiu pela possibilidade de aplicação da substituição da pena privativa de liberdade por prisão domiciliar de mães detentas. Assim, existe amparo legal para aplicação de pena alternativa que viabiliza e protege a maternidade e propicia a convivência e o pertencimento familiar da criança, contribuindo para a educação e formação cidadã, contudo, a falta de infraestrutura adequada e pessoal com preparo profissional nos estabelecimentos prisionais dificulta a efetivação do direito ao pertencimento familiar.
