Alors que l’érosion côtière met en péril nombre de territoires littoraux, l’effet érosif du batillage, soit les modifications hydrodynamiques provenant du déplacement des bateaux, ne fait pas l’objet d’un encadrement normatif spécifique et généralisé au niveau international qui soit susceptible d’être adopté en droit interne, et ce, contrairement à d’autres impacts de la navigation, comme les déversements d’hydrocarbures. Délaissant la perspective usuelle de la gestion de l’érosion à partir du littoral, les auteurs de la présente étude comparative examinent la manière dont les droits français et canadien régulent les déplacements nautiques de façon à réduire le phénomène d’érosion des berges. Les auteurs explorent ainsi ces cadres normatifs et soulignent les liens entre une réponse appropriée environnementalement et certains facteurs, tels que la spatialité de la norme, l’harmonisation de l’interface terre-mer et l’inclusion des parties prenantes au moment de l’élaboration normative. L’exercice révèle également ces lieux juridiques où le littoral bénéficierait d’une considération supplémentaire du batillage.
