Abstract
이 글은 직장 내 괴롭힘을 규율하는 법제에서 직장 내 괴롭힘의 정의 규정을 비롯한 규제내용과 구제제도를 중심으로 캐나다의 연방법과 퀘벡주, 서스캐처원주, 매니토바주, 온타리오주의 관련법을 비교 검토함으로써 현행 직장 내 괴롭힘 규정의 한계를 개선할 수 있는 방안을 찾는 것을 목적으로 한다.우리나라에서 직장 내 괴롭힘을 규율하고 있는 근로기준법, 산업안전보건법, 산업재해보상보험법의 내용을 간략히 살펴본 후, 앞서 언급한 캐나다의 주의 관련 법령을 중심으로 괴롭힘 규제내용을 검토하고, 괴롭힘 피해자를 구제하기 위해 어떠한 제도와 절차를 마련해서 운영하고 있는지 검토하였다. 노동기준법에 규정을 두고 있는 퀘벡주, 고용법의 노동안전보건편에 규정을 두고 있는 서스캐처원주, 노동안전보건법에서 괴롭힘을 규율하고 있는 매니토바주와 온타리오주에서의 각 법제도의 공통점과 차이점을 통해 그 특징 및 시사점을 정리하였다.캐나다에서 괴롭힘은 크게 두 개로 나눠 차별적 괴롭힘은 일찍부터 인권법에서 규율하고 있었으며, 차별금지사유 이외의 괴롭힘은 노동관계법에서 규율해오고 있다. 노동기준법에 규정을 두고 있는 퀘벡주를 제외하고는 직장 내 괴롭힘은 주로 노동안전보건법에서 다루고 있다. 괴롭힘은 각 주마다 조금씩 다르지만, 유사한 형태로 정의되며, 성적 괴롭힘이 괴롭힘에 포함되는 개념으로 정의된다. 괴롭힘 행위의 주체를 제한하고 있지 않으며, 반복되는 행위일 것을 요하지만 1회적인 경우라도 심각한 결과를 초래하는 경우 괴롭힘이 인정되기도 한다. 그리고 괴롭힘 행위가 합리적 조치로 인정되는 경우 괴롭힘이 아니라는 규정을 두고 있다. 구제와 관련해서 별도의 구제절차와 구제기구를 두고 있는 주로는 퀘벡주와 서스캐처원주가 있는데, 직장 내 분쟁해 결과 재판절차 외에 별도의 행정기구를 통해 신속하고 유연한 구제를 도모하고 있다. 이러한 캐나다 법제의 특징은 우리 법에 시사하는 바가 있으므로 추후 법 개정을 논의할 때 참고할 만하다.
