Abstract
Abstract Generally speaking, when the requirements for the creation of a valid contract have been satisfied—that is to say, there has been an offer and acceptance of reasonable certainty; the parties have capacity, there is consideration; and any necessary formalities have been complied with—the resulting agreement will be legally enforceable. But sometimes the courts refuse to enforce a transaction (or parts of a transaction) even when these requirements are present because of its ‘connection’—the word is deliberately vague—to an activity of which the law disapproves. An agreement to commit a crime, for example, is normally unenforceable. Other examples include gambling agreements and agreements in restraint of trade.
