Abstract
Abstract The law is reluctant to allow a direct plea that a contract should be set aside because one party was in a vulnerable or weak bargaining position. All persons over the age of eighteen and of sound mind are generally treated as of equal capacity for the purposes of contracting. Nevertheless, from time to time the law will step in to redress imbalances between stronger and weaker parties. Occasionally the intervention is indirect as when, for instance, courts invoke special rules that protect parties subject to exemption clauses or that protect consumers against certain types of unfair terms.
