Abstract
Abstract Shortly after he was promoted to the US Second Circuit Court of Appeals in 1.01 1925, that great American jurist, Judge Learned Hand, was confronted with the problem of expert evidence in a patent case,1 a subject upon which he had expatiated in a seminal article in the Harvard Law Review a quarter of a century earlier when, aged 28, he was a practising lawyer. The case concerned a claim for infringement of a patent for electrically welding thin-walled tubing, the kind of tubing that was appropriate for use in bicycle wheels. The defendant to the claim had developed a faster method of welding, the issue in the case being whether that infringed the plaintiff ‘s invention. To arrive at a verdict, the court had scrutinized a wealth of complex electrical, metallurgical, and mechanical evidence.
