En la teoría jurídica contemporánea, la configuración constitucional estructura la plataforma para la garantía de los derechos y libertades. Así, la norma constitucional mexicana, contiene supuestos jurídicos que resultan en la práctica excluyentes entre sí, circunstancia que implica prever a un mismo nivel constitucional una contradicción, lo cual trae consigo un sincretismo metodológico, constitucional e incluso teórico. Es finalidad del presente trabajo no solo el denunciar la contradicción, sino demostrar que la constitución mexicana en su contexto, requiere integrar una coherencia interna tomando como referencia el principio de igualdad en la definición y reconocimiento del derecho indígena basado en los usos y costumbres y el derecho positivo, así como describir el pluralismo jurídico nacional, aplicados ambos conceptos a dos casos paradigmáticos en el Municipio de Amealco de Bonfil, en Querétaro: Macedonia Blas y Alberta Alcántara y Teresa González.
