Abstract
Les décisions de fin de vie font l’objet d’un vaste débat social dans plusieurs pays occidentaux. Le présent texte porte sur les décisions relevant du seul droit civil du Québec et ne traite donc pas de l’euthanasie ou de l’aide au suicide. Après un rappel du cadre normatif général touchant à l’inviolabilité de la personne et au consentement aux soins médicaux, est abordée la situation spécifique du patient en fin de vie. S’impose alors, à l’égard de la poursuite ou de l’arrêt de traitement, le respect de la volonté de la personne majeure apte. Celle-ci peut également exprimer son autonomie par le biais de directives de fin de vie, dont les avantages et les limites sont analysées. Si la personne est mineure ou majeure inapte, la recherche de son meilleur intérêt doit guider le tiers habilité à décider pour elle et, s’il y a lieu, le tribunal. Abordant ensuite les soins palliatifs, l’auteure souligne leur portée, les ressources extrêmes qu’ils peuvent offrir en toute légalité et la richesse humaine unique qui les caractérise. Elle se demande s’il faut vraiment aller plus loin et légitimer l’acte de donner la mort.
