Abstract
Dans cet article, l’auteur propose une analyse à la fois médicale et juridique des manifestations indésirables liées à la prise d’antidépresseurs. Médicale, tout d’abord, puisque malgré leur très grande popularité, les antidépresseurs demeurent des médicaments dont la toxicité peut engendrer chez certains usagers la survenue de symptômes impliqués dans la commission d’actes criminels. Sans être une cause directe de violence, les antidépresseurs peuvent donc constituer, chez certains sujets, des agents influents dans la prédisposition ou le déclenchement de conduites criminogènes. Cette étude, une fois complétée, servira de base à l’analyse de la responsabilité pénale des personnes faisant l’usage d’antidépresseurs et ayant commis des crimes en cours de traitement ou de sevrage. Il s’agira, plus précisément, de déterminer les moyens de défense disponibles ou envisageables ainsi que leur conformité avec les symptômes observés chez certains usagers d’antidépresseurs au moment du crime.
