Abstract
Ce texte analyse la jurisprudence dans laquelle la Charte canadienne des droits et libertés a eu un effet significatif sur le droit de la famille au Canada. Il a trois objectifs. En premier lieu, il rassemble pour le chercheur ou étudiant francophone les principaux arrêts basés sur la Charte en matière familiale, que ce soit au Québec ou ailleurs au Canada, avec des références à la doctrine. Les jugements sont considérés par l’entremise de trois catégories, soit la définition de « conjoint », dans les provinces de common law et au Québec; la protection de l’enfant et l’art. 7; et les liens entre parents et enfants. En deuxième lieu, le texte met en relief l’impact plus profond de la Charte dans les provinces de common law qu’au Québec. En troisième lieu, sur le fond, il met en lumière un contraste entre le traitement accordé aux contestations menées par des adultes et celui accordé aux contestations menées par ou au compte des enfants.
