Abstract
Le développement du droit d’auteur a été motivée depuis toujours de façon à bien gérer les rapports délicats entre les auteurs et le public afin de tenir compte des intérêts de chacun. Si le public veut avoir accès au travail de l’auteur en vue de bénéficier des avantages culturels qui y sont transmis, on doit également reconnaître à l’auteur une exclusivité d’exploitation de son œuvre pour les fins de sa commercialisation. Le concept d’épuisement des droits a cependant été élaboré en vue de tempérer l’exercice exclusif du droit d’auteur. Où se situe le point d’équilibre entre les droits intellectuels et ceux du public dans le respect du libéralisme économique? L’objectif de ce texte est de répondre à cette question.
