L’égalité comme valeur semble avoir de nos jours une place particulière dans la philosophie du droit. En effet, plus que toute autre, l’aspiration à l’égalité est devenue le palimpseste de toute communauté moderne. Toutefois, la question de sa prédominance sur les autres valeurs - et notamment la liberté - s’affirme de plus en plus comme une problématique d’actualité. À travers une perspective historique et philosophique, l’égalité s’affirme comme une valeur dont la genèse se trouve au coeur de la « démotique » occidentale. Ainsi, la notion a été tour à tour appréhendée comme la transposition juridique d’une forme d’égalité primordiale, comme un instrument de protection égale de certaines libertés fondamentales, comme un principe politique de participation à la démocratie, la formulation des conditions d’accès équitable aux ressources, une égalité des chances ou une égalité de traitement devant les instances judiciaires.
