Abstract
Influencée par les écrits de certains juristes, la Cour d’appel du Québec avait décidé, dans l’affaire Camden-Bourgault c Hôpital de L’Enfant-Jésus, que les rapports juridiques entre le patient et l’hôpital étaient de nature extra contractuelle, et que les médecins, exerçant au sein d’un établissement de santé n’étant pas des préposés de celui-ci, ne pourraient engager sa responsabilité. Les travaux remarquables du Professeur Paul-André Crépeau durant un demi-siècle, semblent avoir été négligés ou méconnus par plusieurs juristes contemporains. Une lecture soigneuse de ses écrits démontre sa prescience et la façon novatrice avec laquelle il analyse les principes juridiques soutenant les fondements de la responsabilité contractuelle de l’établissement à l’égard de ses patients.
