Abstract
Se déroulent actuellement des négociations entre le Canada et l’Union Européenne visant la conclusion de l’Accord économique commercial global (AECG). Dans cet article, nous examinons dans quelle mesure cet accord, s’il est signé, aura un impact sur la souveraineté du Canada à régir l’équilibre de la politique canadienne en matière de brevets pharmaceutiques. Nous concluons que, bien que la signature de l’ AECG aura pour effet de prolonger la durée de commerce exclusif de compagnies pharmaceutiques novatrices au Canada et donc, d’augmenter les dépenses de médicaments, il demeure que c’est la façon dont le gouvernement canadien choisira d’implanter ses obligations dans les lois nationales qui aura une influence sur le caractère équilibré de la politique canadienne.
