Abstract
Ce texte analyse le traitement de la diversité culturelle et religieuse par le Code criminel de 1892 à partir de deux exemples de dispositions qui font explicitement référence à de telles minorités : celle relative à la criminalisation de la polygamie, qui mentionne la pratique du mariage spirituel ou plural des mormons, et celle relative à la prostitution de la « femme sauvage ». Dans les deux cas, les dispositions seront analysées en tenant compte du contexte socio-historique dans lequel elles ont été adoptées. Cette étude d’infractions qui visent les relations maritales et sexuelles fera ressortir le fait que le droit criminel de l’époque, fortement empreint de la morale victorienne, a été utilisé comme un outil d’assimilation des minorités dont les mœurs différentes étaient jugées immorales.
