Abstract
Cet article utilise le cadre conceptuel développé en économique pour expliquer les comportements dits malhonnêtes et en minimiser leurs impacts. Ce canevas est appliqué concrètement aux cas des fraudes financières et à l’implantation de mécanismes visant à minimiser leur occurrence et leurs conséquences indésirables. Notre étude montre que si la réglementation s’avère un élément primordial pour réduire les coûts sociaux engendrés par les fraudes d’investissement, dans bien des cas, d’autres mécanismes sont également nécessaires. Ceci est appuyé par plusieurs recherches récentes qui tendent à démontrer que l’on peut prédire, moyennant la disponibilité d’informations minimales, les actes de fraude. Dans ce contexte, nous examinons la complémentarité de différents mécanismes de prévention, dont le cadre légal, pour prévenir les actes de fraude financière et, conséquemment, pour réduire les coûts sociaux qui y sont associés.
