Abstract
Bien que le phénomène de la grève étudiante jouit d’une légitimité politique au Québec depuis des décennies, cette manifestation de la liberté d’association a subi une délégitimation lors de la grève de 2012 en raison de la perception que, contrairement à la grève de salariés prévue au Code du travail, elle n’était ni autorisée ni encadrée par le droit. Or, la démocratie étudiante est encadrée par la Loi sur l’accréditation et le financement des associations d’élèves ou d’étudiants ainsi que par les lois d’application générale telle la Loi sur les compagnies et le Code civil. Cet article explique l’interaction entre ces lois et les pratiques des associations d’étudiants. Cette explication fonde une critique des jugements rendus en la matière pendant la période que l’on appelle « le Printemps érable » et ouvre la réflexion sur des pistes potentielles d’une reconnaissance formelle d’un droit de grève étudiant.
