Abstract
Le présent texte s’intéresse à la législation facilitant les recours des gouvernements provinciaux contre l’industrie du tabac pour se voir rembourser les dépenses de santé effectuées, notamment, pour le traitement des maladies reliées au tabagisme. L’auteure y argumente que le traitement de la causalité au sein de ces lois démontre que, bien qu’elles soient décrites comme facilitant les recours des gouvernements, elles sont en réalité le résultat d’un compromis qui est parfois à l’avantage de l’industrie. L’auteure tente également de démontrer que l’adoption de cette législation au Québec, dans un texte calqué sur la législation de la Colombie- Britannique — elle-même inspirée de la législation de la Floride — est caractérisée par un manque d’attention à l’égard de certaines particularités du droit québécois, plus particulièrement en ce qui concerne le fait générateur de responsabilité en matière de responsabilité du fait des produits, ainsi que la causalité.
