LE DROIT SELON LE MODÈLE DE LA LOI DE LA LOI : LES LIMITES DE LA THÉORIE DE LA RECONNAISSANCE DE HONNETH ET DE L’INTERPRÉTATION ANTHROPOLOGIQUE DU DROIT DE SUPIOT

Abstract
Cet article montre les limites de la démarche épistémologique privilégiée par la théorie de la reconnaissance d’Axel Honneth. Pour interroger cette démarche, l’auteur s’intéresse à la conception anthropologique du droit d’Alain Supiot qui subordonne, tout comme la théorie de la reconnaissance, la possibilité du droit à une condition qui lui est extérieure, à une métarègle, une loi de la loi. En s’appuyant sur un principe extérieur qui en garantirait l’opérativité et l’effectivité, le droit ainsi pensé présuppose la capacité du social à s’auto-transformer en fonction des exigences de la raison. Chez Honneth, l’existence de l’opération d’apprentissage des sujets individuels et collectifs demeure supposée, tandis que chez Supiot, la loi de la loi est assurée par ce Tiers garant mis en position de condition transcendantale de tout ordre juridique. Tout en insistant sur le caractère problématique du modèle de la loi de la loi, le présent article propose un déplacement épistémologique prenant acte de la dimension pragmatique de l’indétermination. La finitude de la raison implique qu’il n’est pas possible, ni dans la perspective de la norme elle-même ni dans celle du juge au moment interprétatif, de formaliser les conditions de l’application. La possibilité du droit à se réaliser effectivement dépend plutôt à la fois de l’usage qui en est fait par ceux qui ont charge de l’appliquer et de sa construction coopérative par tous les acteurs concernés.
