Abstract
Dans cet article, j’examine un pan de la vie et de l’œuvre de Mary Ann Shadd (1823-1893), une abolitionniste canado-américaine, afin de déstabiliser l’historiographie dominante en droit international en matière d’esclavage. Privilégiant une approche intersectionnelle, j’essaie de replacer la « femme noire » au centre de sa propre histoire, plutôt que d’en faire une figure accessoire dans l’histoire triomphante de l’abolition de la traite négrière et de l’esclavage menée par des hommes occidentaux. J’étudie les rapports multiples et contradictoires de Mary Ann Shadd vis-à-vis du droit. Je montre comment elle a cherché tour à tour à s’émanciper par le droit, avec le droit et contre le droit, à des degrés différents et avec des succès variés. Dans son principal ouvrage publié en 1852, A Plea for Emigration, Mary Ann Shadd a défendu un projet d’émigration pour les Noir.es américain.es vers le Canada en mobilisant des notions juridiques, et notamment des notions de droit international. Or, Mary Ann Shadd a participé à un mouvement plus vaste au sein duquel les Noir.es américain.es étaient en quête d’autodétermination. Ma thèse est que la position défendue par Mary Ann Shadd doit nous inviter à revisiter les rapports que nous tenons pour établis entre colonialisme, souveraineté, liberté et intersectionnalité.
