Abstract
L'ouverture d'un régime de protection au majeur inapte doit toujours être le résultat d'une décision judiciaire où le greffier de la Cour supérieure du Québec a le rôle d’adjudicateur. Une telle décision ne peut être rendue que dans l’intérêt du majeur et le greffier a pour rôle de veiller à cet intérêt. Au même titre, le curateur public a un mandat de protection des personnes inaptes. À ce titre, il bénéficie notamment d’un pouvoir d’intervention et de surveillance lors de l’ouverture des régimes. En ce sens, une étroite collaboration entre les représentants du curateur public et les greffiers semblent un élément clé d’une protection efficiente du majeur. La présente étude vise l’analyse, du point de vue des greffiers, de la nature du rôle dévolu aux représentants du curateur public. À cet effet, elle utilise une double approche, soit en premier lieu une analyse du cadre juridique dans lequel évoluent chacune des parties et en second lieu, une analyse des résultats obtenus lors d’une enquête effectuée auprès des greffiers de la Cour supérieure.
