L’avenue de « l’oncologie de précision » a permis l’intégration en clinique de tests basés sur la génomique permettant d’individualiser le traitement au profil génétique du patient et aux variantes géniques de son cancer, tel le test Oncotype Dx. L’intégration de cette technologie en clinique amène son lot de changements dans le traitement des patients par les oncologues : d’une part, elle implique l’individualisation de la prise en charge du patient par l’oncologue traitant et, d’autre part, l’intégration de la pratique interdisciplinaire, notamment le recours aux décisions collectives des comités de thérapies du cancer (CTC). Les CTC étudient le dossier de chaque patient individuellement et, suite à des discussions collectives, rendent une décision thérapeutique. Cet article a ainsi pour buts d’étudier les obligations et responsabilités des oncologues dans les traitements individualisés des patients et d’analyser la nature de l’interaction juridique que les oncologues peuvent avoir dans ce contexte, particulièrement à travers le recours à un CTC dans le cadre de l’élaboration du traitement
