Abstract
La question de l’avortement continue à diviser la jurisprudence et à déchirer la doctrine, faute de consensus social sur la définition commune de la nature et du statut juridiques de l’enfant à naître. Chaque société ayant sa culture et sa tradition juridique, le statut juridique de l’enfant à naître ne fait pas l’unanimité entre les États. Dans ce cas, on peut se demander si la notion de droit à la vie varie en fonction du milieu culturel dans lequel la vie se développe. La réponse à une telle question n’est pas évidente et peut résider dans le degré de perception de la notion de dignité humaine dans chaque société, ce qui plonge d’ailleurs le droit à la vie dans un pluralisme juridique et culturel. Face à un tel pluralisme différent et opposé, le présent article se propose de démontrer comment la notion de la marge nationale d’appréciation peut permettre de concilier les droits humains et la diversité culturelle, notamment dans le cas du droit à la vie de l’enfant à naître.
