Abstract
Les auteures s’interrogent sur le statut juridique du corps humain, lequel apparaît hybride, exigeant une approche sui generis et se situant dans une position médiane entre les catégories d’objet et de sujet de droit. Un positionnement – certes nécessaire – sur le statut juridique du corps humain engage une réflexion bioéthique contemporaine sur deux aspects. Dans un premier temps, la détermination des pôles de l’existence juridique peut poser problème en raison du « décalage » des temps juridique et biologique : on plaide en vain pour anticiper l’avènement de la personnalité juridique, d’une part, et pour la prolonger au-delà de la mort, d’autre part. Si l’acquisition de la personnalité juridique doit être considérée en conjonction avec la procréation assistée et les projets scientifique et parental, son extinction ne peut qu’être tributaire des technos-sciences qui tendent à une prolongation de l’ultime fatalité. Dans un second temps, le traçage des pourtours de l’intégrité du corps humain se révèle dans une protection de l’intégrité du corps humain vivant, durant l’existence humaine, et se poursuit par un respect du cadavre, au moment de sa mort, et du prolongement de ses volontés par les vivants. Cette inviolabilité de la personne humaine, sujet de droit, se meut en un respect du cadavre, objet de droit, fondé sur le respect dû à la dépouille mortelle.
